Legal Question in Family Law in Virginia

What Are My Chances?

A friend of mine has been incarcerated for the past six years. She has 3 minor children that a neighbor of hers has had sole custody of since her incarceration. When she took custody of the children they were 3months, 1.5 yrs, and 9 yrs old. My friend now believes that her neighbor has abused her position as custodial caretaker by falsifying documents regarding her children for her personal gain. She has asked me to go to court to file for joint legal custody so that there are an extra set of eyes looking out for her childrens best interest. Neither I nor the neighbor are of biological relation to my friend or her children. If I were to file based on the request of the natural mother is that good enough for my motion to be granted or is it a waste of time?

Re: What Are My Chances?

Before initiating any such action as you've described, you would be well advised to have a consultation with an attorney who handles custody matters in the local court where your filing would occur.

If you proceed without such a consultation, you may, indeed, end up wasting your time and, perhaps, even something more than that(in my view).
