name change

I want to add my last name to my son's name, I am his custodial parent and mother, his father has chosen to not to play a part in his life but he refuses to sign the paper to have it done, what optiona so I have?

Re: name change

Petition the circuit court in your area for a "Name Change for Minor Child". Some clerk's office of circuit courts(civil division) have the packet of forms with instructions as to how to do this pro se without an attorney.

If the non custodial parent objects, the court will hold a hearing to determine whether the proposed name change is in the best interests of the subject child and make the decision on that basis.
