Legal Question in Family Law in Virginia

Change in Child Support after agreement

An agreement on Child Support was made in mediation. The agreement was filed with the court (no appeal was made). The amount was decided on based on the Custodial parent staying in the marital home and no spousal support made. In the agreement (PDA) it states Child Support will be reevaluated in 2008. Now, the non-custodial parent wants the support lowered(he is paying more than guidelines). No change in circumstance has taken place. Does he have a good chance at getting it lowered?

Re: Change in Child Support after agreement

Could be, possibly, if he goes into court and convinces the judge that he was HORNSWOGGLED (you may need to look it up) into agreeing to a child support obligation above the guidelines. Otherwise, probably not.
