Legal Question in Family Law in Virginia

Change in Custody - non contested

My husband and I have custody of his three children. This was completed through a mediator 3 yrs ago. One of the children who is now 15 has requested to move back with his mother, we have no issues with this and will not contest his decision. We would like it to be done legally and have a child support review done as well. Is there a form to file with the court for the change in custody or will the mediator need to be contacted ? The child support is received through DCSE, once the court has been filed with will they do the child support review ?

Re: Change in Custody - non contested

If there is a current court order which deals with the issues of custody and support, a motion will need to be filed with that court for a review of the support and modification of the custody arrangements.

If this court is a J&DRD Court, the court has forms which you can use to file this motion. However, if these matters are still within the jurisdiction of

a circuit court, you will likely need the services of an attorney in order to proceed.
