name change of a minor

My son is 5 years old. I have been with my fiance since my son was a baby. His real father pays support but has never wanted to be in my son's life. My son has my last name. I have another child with my fiance and I want to change my 5 year old's last name to that of my fiance who is basically his dad. How can I do this? I want the real father to still be obligated to pay support, so we don't want to go about a legal adoption right now.

You can file a Petition for a name change in the Circuit Court for the city/county where the child resides. However, to have the name change granted you will need the consent of the child's birth father.
