Name change for my son (Last name)

My son was born in Guatemala to a Guatemalan father 9 years ago. We don't keep in touch since almost 7 years ago. I have full custody of my son.

I am presently married to an American and he would like to give my son his last name.

Is this possible? How?

(My son and I are U.S. citizens).

Yes, it's not only possible, but quite easy to do and without the assistance of a lawyer.

You merely go to the clerk's office(civil division) of the circuit court in the city or county which is convenient fore you and pick up

the packet of forms entitled Name Change For A Minor. This packet will contain the forms along with the instructions as to how to fill them(the forms) out and file them. If you have any questions regarding matters (other than legal issues)not addressed in these forms and instructions, one of the clerks will very likely be happy to assist you.

May I add to Mr. Henderson's excellent advice a further possibility: your husband can adopt your child, giving the child his name and making the child his full heir. You and he can accomplish this without an attorney, though sometimes it gets a little confusing when the father is nowhere to be found.
