Legal Question in Family Law in Virginia

change of venue

My husband was divorced in VA and his exwife is still in VA. Is there anyway to change the jurisdiction of their case to GA? I would love to see her make a trip instead of him.

SAince you haven't said what he wants to file, there's no way to answer you, but I'll give you the general rule.

Assuming she remains there, anything he wants to file versus her must be there. Also, if there is a child, anything concerning the chikld must be filed in the state where the custodial parent is.

Unfortunately, no. Jurisdiction is pretty specific. All divorce matters are in Virginia if that's where it started. Had he waited to file divorce until living in GA for six months, he could have filed it there.
