child abandment

my x lives in GA and has visetation to my almsot 4year old daughter but he has only sees her about once a year if i am lucky and is always behind on child support do u knwo the VA law on child abandment?so that my hubby can adopt my daughter after all he is the only daddy she knows...... thanks Bekah

You and your husband can file a petition for stepparent adoption. If your ex does not consent, you can give him notice, and state that he is withholding consent contrary to the best interests of your daughter. If he really sees her rarely and hasn't kept up on child support, you have a chance of getting the judge to approve the adoption.
