Child abandonment In Va

My daughters father has had, no contact with her since march of 2008. He has paid no child support since she was born (Jun.07) and, I was wondering how long does it have to be before I can pettion the court for my husband to adopt her, or if this qualifies for child abandonment. What can be done for my husband to adopt my daughter?
