Child Abduction

No legal custody has ever been established. The father of my child sent his mother to the childs school and picked him up out of school. The grandmother took the child to the father and the father left town with the child. I want to know if this is legal and if not what can I do about it?

I don't what right his mother had in picking up the child from school, but that's between you and the school.

If there is no custody order either one of you may take the child wherever you like. Going to court for custody is not only about giving it to someone it's also about taking it away from someone who already has it. If he has not had his custody limited, he may take the child where he pleases. The way to limit his custody is through a Court Order of course.
