Child Name Change

My 9 year old son currently has his birth father's last name. I am getting married soon and would like us all to have the same last name. I was never married to his birth father. Can I change my son's name without his father's permission?

You can pick up a a set of forms with instructions at the clerk's office of your local circuit court (civil division)entitled "Name Change for a Minor Child" which will explain how exactly to do it in your particular situation.
