Legal Question in Family Law in Virginia

Child custody

The Alexandria Juvenile & Domestic Relations District Court has jurisdiction over my daughter. I am the non-custodial parent. Custodial Parent is Active Duty Army and single. He was allowed to move with my daughter from Virginia to Kansas because he received ''Military Orders''. The Alexandria JDR Court retains jurisdiction even though ex-husband and daughter moved, because I still reside in Virginia. My question is this I live two hours from the court that has jurisdiction, can I have the case moved to the JDR Court in the county in which I live in?

Re: Child custody

Yes, you could make inquiry to the Alexandria J&DRDC to see whether they would be willing to transfer your case to the Virginia jurisdiction where you currently reside.

I would note, however, that the longer the child remains a resident of the state of Kansas, the more likely it becomes that the courts of that state will at some point assume jurisdiction of the custody matter.
