Child Custody and Guardianship
For the past few years, my parents have had shared custody of my sister and I, and it has always been fairly dysfunctional. Now my sister is nineteen, and I just turned seventeen. Since my dad has screwed up his finances so bad, my mom is suing for sole custody of me. I cannot stand to live in either household; I would rather my sister have custody of me, but we're not sure what the court would like to see in a competent guardian. She's got an apartment we can live in, and she's working on getting a second job so she can have a salary to actually live off of. Her current financial situation is what I fear will make the court discount her as a possible guardian.

No, the court is unlikely to award custodial powers over your person to
your nineteen year old sister for a variety of reasons, including the one you've mentioned, i.e., financial considerations.
