My husband shares joint legal custody with his 7 year old daughter's mother currently. We currently have the child because her mother is out of town with her boyfriend visiting friends, but he has filed a petition with court requesting that he be granted full custody due to child neglect. The child is supposed to go home with her mother at the end of this week. Our question is this if he refuses to allow the child to go home can he get in trouble by doing this?

Yes, by keeping his child from the mother in apparent violation of the current court order, your husband could be found in contempt of court and subject to sanctions, accordingly.
