child custody

the mother and father of a child is not married and neither has filed for custody the mother leaves the state of Va. and goes to Ky. the father files for custody in the state of Va.the mother was served papers to appear for the hearing and does not appear the father is given temp custody until the next court date does the State of Ky. have to honor the order from Va.

Yes, because under the Uniform Child Custody Jurisdiction Act (UCCJA), the jurisdiction to rule on the matter would appear to be with Virginia (assuming that the child did not reside in Kentucky for at least six months prior to the filing of the Virginia petition).
