What requirements must be met in order for one parent to establish full legal custody?

The standard for determining custody of any particular child is the proverbial best interests standard, and the nine criteria outlined in Va. Code Sec. 20-124.3 form the basis for this determination which all Virginia courts must take into account in deciding the issue of custody of a child.

The parent whose personal situation is most likely to conduce to the fullfillment of those nine criteria is

the one whom the court is most likely to award custody of the subject child.
