Legal Question in Family Law in Virginia

child custody and support

What are my rights when it comes to how I use child support for my daughter even if she is living somewhere else?

My daughter moved to maryland due to saftey reason with my mother due to my daughter thinking her father would come to our house looking for her. Verbal agreement between my mother and me that i would send money when i could do to finances but when my daughter started college instead of going to high school i would send all the support which i receive from her father. My mother and I are now not agreeing on how my daughter should attend school, i want her to go to high school and she want her to get her ged and go to a college. now my mother is taking me to court for custody and back child support money that i receive for my children

Pardon me for maybe not digesting the whole story. Anyway, in my view, you need to find a good family problem professional MEDIATOR straightaway. There are some very good ones in my area and I imagine there are also in yours. A MEDIATOR need not be a lawyer but that is what I would recomend.

Re: child custody and support

You should request that your mother return your daughter to your custody which would make the court action which she has initiated moot (irrelevant).

Your mother is not the designated payee for the

child support being paid for your daughter and she has no basis to claim "back child support".

Your mother, however, may have a claim for necessaries which she purchased in your daughter's behalf while she was in residence with your mother. Whatever these sums may be, they definitely cannot be categorized as "back child support".
