child custody-removal from mother in jail

my sister lives in georgia and i live in virginia. she is currently in jail awaiting a bond hearing in 4 days. she is already on probation and her husband (not my nephews father) has him. how can i get him back to virginia? both the parents do drugs and have criminal records and i am worried for his welfare. thanks.

You could peitition for custody of the child in the Georgia juridiction where the child currently lives. However, you would be well advised to hire a Georgia lawyer to represent you in this proposed custody action in order to have any reasonable chance of success.
