what do i need to do since my childs father wants to give up his rights? do my husband and I need a lawyer for this?

As a practical matter, no Virginia court will permit your child's father
"to give up his rights" (to this child) unless your husband is ready to assume those rights(as well as obligations) through what is known as a step-parent adoption of the child.
And, yes, you should have an attorney to handle such a matter.
