Legal Question in Family Law in Virginia

Child naming

My child's father wants to change the last name of our child to his last name. My child's father and I have never been married. When my child was first born, the father denied my child. It was only proved about 4 months ago with a dna test that he is the biological father of my child. Can he legally change my child's last name? And What can I do to stop him?

Re: Child naming

The father can file a petition in the local circuit court to change the child's name. You as the child's mother would have a right to oppose the change and to participate in the hearing that would be scheduled in the matter to convince the judge that it would likely not be in the child's best interests.
