Legal Question in Family Law in Virginia

Child Safety and Mother concern

My sister has joint custody with her having living rights of her 1yr old daughter. The father sees the child every other weekend. The father is verbally abusing my sister and is physically threating her.

He also is showing up and calling all times of the day all days even when its not his day to come get the baby. He tells my sister he will beat up any man she bring near his daughter. What legal action can we take to have him stay away from my sister as she is afraid for her life and her children, but still comply with the custody order?

She is afriad to get a restraining order becuase she thinks that he will hurt her for doing so. How can she protect her self.

Re: Child Safety and Mother concern

You need to obtain a protective order. You should also consult what local agency/organization assists individuals dealing with domestic violence for assistance. Your local social services department could probably refer you.
