Legal Question in Family Law in Virginia

The Child Support Agencies

I need a detailed outline of policies and procedures for the Virginia Child Support. When support was ordered, he was allowed to bring in 3 pay stubs. He works construction which is seasonal. The pay stubs were months of Nov.Dec.Jan. I started my divorce proceedings 3 yrs later and discovered my child support was incorrect.I went back to DCSE and his order went from 506 to 1107.He quit his job and moved out of state 4 yrs ago.He pays when he wants and consistantly stays unemployed. He complains that the payments are too high but will not go in and ask for an amendment. He now owes 48,000 and he has never done a day in jail & maintains a drivers licence. I have asked for federal warrants & he maintain a job by court order. It took DCSE 1.5 yrs to serve him with the increased order even though I actively received support weekly from him stating he was unlocateable. Now,DCSE acts like they can't do anything but play the waiting game with him. He violates the basic of DCSE policies like not giving hs physical address. The list goes on. They say it's Florida fault and they say it is Virginias. Either way it's not being handled correctly.

Re: The Child Support Agencies

Q: Fed up with DCSE

A: You are in a bad situation having to rely n two states to coordinate this case. There is no other way to do it tho. You really don;t have a question - you just vent your frustration which I understand. The Virginia Code (and every other state code) lists the laws for the multi state child support acts. The answers you want are there but I have to say there is no effective way to do this but for you to make a royal pain for the DCSE in Florida.

Alternatively, a Florida attorney to help you bring him to justice would help.

Good luck.
