Legal Question in Family Law in Virginia

Child support appeal

The ex-wife took my husb to court for an increase in child support. The case was dismissed because our lawyer determined that the original child support case from '94 was appealed years ago to circuit court and was never resolved (My husband went on disability at the time) So the judge in family/domestic court dismissed it. What would the ex-wife have to do to get the case moved back to family court? Are there a lot of hoops to jump through? And could this be done without a lawyer?

Re: Child support appeal

If the entire case has been dismissed and the duty to support continues, she need merely refile it in the Juvenile & Domestic Relations District Court which does not require the services of an attorney.
