Legal Question in Family Law in Virginia

Child support arrears

The bio mother is behind in support payments and she is going against the judges orders to get a job and pay. She still has one child that she does share custody of with my husband. If the judge orders her jail time, what will happen to the child. Will my husband be notified of the courts attempt? Does she have a say of where the child will reside while she is incarcerated? Thank you.

Re: Child support arrears

You are presumptuous in assuming that the court is going to put this mother in jail based upon the facts and under the circumstances which you've described.

I would predict no jail time and, therefore, your other questions, as they say in the law, are

necessarily moot, meaning irrelevant.
