Legal Question in Family Law in Virginia

Child support delinquency

I'm taking my ex to ct for not paying child support on time or not at all. He is a couple of months behind (over more than a thousand dollars behind) - the ct date is next month. I'm sure he will still be behind on pmt the day we go to ct. Can he be ordered to pay what's delinquent, as well as be ordered to set up pmt through direct payroll deduction (direct deposit or garnishment)? I want it direct deposited into my son's bank acct - I'm tired of running him down, calling him every two weeks about pmt. I use that money to pay for my son's daycare, and he's making it very hard to keep up with the payments - I'm always behind, b/c of his irresponsibility - he knows what I use the money for. He just doesn't care! What are my options for requests in court next month? I really do want to ask for all that he owes, that way I can pay my son's daycare up in advance for a while. Pls advise. Thank you.

Re: Child support delinquency

Yes, you can certainly request that the court order him to pay the full amount of the arrears owed and that an automatic payroll deduction be implemented under the auspices of DCSE(Division of Child Support Enforcement). However, as far as I know the monies collected through the payroll deduction may not be directly deposited into your

son's bank account but must be processed through Richmond and a check issued to you from there.
