Legal Question in Family Law in Virginia

child support

My ex-husband has our 18 yr old son who is a full time college student living with his father. I have our 16 yr old son. Am I entitled to child support, or would it be considered equal while the 18 yr old is living under his household and a full time student? I have also co signed a loan for the 19 yr old in order for him to go to school. I am about to co sign another as his father will not help him.

Re: child support

Unless, there was an agreement between you and your former husband that your 18 year old would be entitled to child support while in college through age 22, or so, which was incorporated in your final decree of divorce, then there is no legal obligation for either parent of this young man to pay for his support.

However, you would, of course, still be entitled to seek and receive child support from the father of the 16 year old while he is still a minor (assuming that it has not already been provided for in the final divorce decree).
