Legal Question in Family Law in Virginia

child support issue

My mother is in the process of divorcing her husband (my stepfather). He is currently incarcerated and therefore unable to pay child support to his previous wife. My question is this: Is my mother's property at stake as a result of his delinquent CS payments? His ex-wife is supposedly trying to place some sort of lean against my mother's house.

Re: child support issue

Your mother is in no way responsible for the child support payments which her now currently incarcerated husband was suppose to be making apparently in behalf of children he had from a prior marriage.

The lien which you've referenced is likely designed to merely encumber(rather than force) the sale of the property and any proceeds which might result from such a sale which could be legally characterized as constituting a marital share due your mother's husband.
