Legal Question in Family Law in Virginia
Child support
I am a legal resident in the USA, residing in virginia. My Ex resides in UAE. Can I apply for child support from the USA? I did not ask for any child support during the divorce and have not been recieving any. I am remarried and have no personal income. My son and I are completely dependent on my present husband. How do I go about applying for child support? How much am I liable to get?
My Ex is earning a very good tax free salary in UAE.
Thankyou!

Re: Child support
Yes, you could file for the support of your children(assuming they've lived in Virginia for at least six months) in the Juvenile & Domestic Relations District Court in the area where you reside. The problem would come, however, in getting proper service of the suit upon the children's father who apparently currently lives and works in the United Arab Emirates(UAE--more than half a world away, so to speak).
Considering the foregoing situation, you might first wish to consider applying for services with DCSE(the Division of Child Support Enforcement)
as they may have one or more attorneys
on board who have expertise in securing international orders for child support. In pursuing such international orders, it is important that all the required protocols (including necessary compliance with any international treaties that may be involved)be followed to the letter, otherwise any order that may emerge from the process might later be challenged or even invalidated.
It would appear that it would be far preferable for you to obtain a support order in a Virginia forum(whether court or administrative, meaning DCSE)rather than an order that might issue out of some tribunal in the UAE which could later prove unenforceable and therefore essentially useless.
You should be able to find the contact information for your local DCSE district office under the Virginia state government pages in the local telephone directory or online at the
Virginia government website.
