Legal Question in Family Law in Virginia

Child Support

I was married to my husband for 7 years before our separation last November. I have two children from a previous marriage - ages 13 and 11 but were 3 & 4 when we got married. I have a son age 7 from this marriage. My husband supported my two children through our marriage and refused me to seek child support enforcement from their father. My question is can I seek child support from him for all 3 children? I know he does not have a legal responisbility to them but since he did support them and was a father to them - they have his last name - I legally changed their name and he still visits them as their father.

Re: Child Support

You cannot require him to pay child support for kids he did not adopt.

You can get support for the 7 year old from him, and you should be able to get support for the older two kids from their father.
