Legal Question in Family Law in Virginia
Child Support Payments
What can I do if I am not receiving child support? If the courts states the father pays such and such every other week and payment is not received can he be arrested? What proof and steps should I take with the Judge? What can backfire on me as the mother?

Re: Child Support Payments
If the father is delinquent in his child support payments, he can be brought before the court to explain his delinquency which can result in jail time, garnishment of wages, loss of driver's license, and income tax refunds, to name just a few of the possible enforcement remedies.
You can contact the Division of Child Support Enforcement (DCSE)and make application for a modest fee to have this Virginia state agency enforce and collect on your case, or you may wish to retain a private attorney to do the job. You could, also , initiate enforcement actions on your own if your case is already within the jurisdiction of the Juvenile & Doemestic Relations District Court.( A clerk can show you you how to fill out the papers for a rule to show cause action in order to get things started.)
