Child Support Reduction

My oldest child just graduated from high school in June. My ex-wife has agreed to a reduction in support. My question is what is the first step in the process? Is this something I can do on my own or do I need to contact an attorney? Any help in this matter would be greatly appreciated. Thank you.

If you are in agreement, you will need to file a Consent Order with the court to be signed by a judge, formalizing the reduction in support. Hiring an attorney would be the easiest way of handling this.

You should consult a lawyer to determine what the correct child support should be; you don't want to agree to a lesser amount that is higher than the guidelines set by the Virginia Code.

More important, you should have whatever arrangements you make for future child support put in the form of an order and have it signed by a judge. Support cannot be modified retroactive to the time the request for modification is served on both parties, so just paying less will not relieve you of the duty to pay what the court ordered, even if the mother agreed.
