Changes in Child Support

SHortly after our divorce my husband sent me notice that he was surrendering shared custody of our 14 year old son, whom he no longer picked up for visitation. I left NC to move to VA near my sister. My ex recently filed to have child support modified (reduced) and although I make more money in NoVA, the cost of living is substantially more. Can I have the support case move to Loudoun County from Mecklenburg? How will child support be determined? The child support schedules are 40% higher here? I contacted the NC court to ask for a continuance. What should I expect in the Loudoun County courts? Our son has had serious medical and learning problems which far exceed any support I receive and he argues over every expense or counseling session, often just refusing to pay his 60%. Can I expect an adjustment to Virginia standards? How long can this take to get an adjustment?

Yes, you should be able to get the child support case transferred to Loudoun County from N. Carolina, but probably will need the assistance of an attorney who's familiar with the Virginia Child Support Guidelines which are used to determine child support obligations in the Commonwealth and who should also be able to advise you regarding the other related issues.
