Legal Question in Family Law in Virginia

Child support in VA

Do I have to petition the court to stop child support, or does the VA law say it can be stopped without filing something in court? My child will be 18 in April. There are no special circumstances with the child.

Re: Child support in VA

There appears to be some disagreement among Virginia attorneys regarding this issue, but, if you have a Virginia order, particularly one which orders one unitary sum per month for multiple children, and one or more of these attains adult status, you should definitely file a motion to have the support reduced by the appropriate amount. (You should also bear in mind that in 1996 Virginia child support laws were modified to require that support continue until a child turns 19 or graduates from high school, whichever occurs first.)
