Legal Question in Family Law in Virginia

child support and visitation

Are there any laws in Virginia regarding a decrease in child support if a child visits their child support paying parent? For example if Kid stays with Dad for 25% of the year then Dad no longer has to pay child support to Mom or has a reduction in child support owed.

Re: child support and visitation

Special calculations for child support are required where a child spends 90 or more days per year with the "non-custodial" parent. Since there are 365 days in the year, your 25% calculates to 91.25 days, so it's close. There are special rules for calculating what is a day, so a careful analysis of the time you have with your child is necessary to determine if you meet the 90 day threshhold.
