Legal Question in Family Law in Virginia

child support

My EX wife is American and I am Egyptian live in the United States, she divorced me in Egypt and she waived her financial and legal rights due to that divorce. She came back to USA. Now she is asking for a child support 5 times more than what I used to send to Egypt. I checked the child support guidelines in Virginia and DC , I found that the child support is around 480 to 553 based on my income. She said that she want to send him to a day care to find a job. Day care is almost 1000 dollars. When I add the 1000 to the calculation I was chocked it is almost 1200 dollars. The question is : if my gross income is 4000 and what am taking home after taxes and my son medical insurance is between 2600 to 2700 , if I will be obligated to pay 1200 a month how am going to survive with 1400? Am paying rent /mortgage between 1100 to 1350 a month plus car payment and bills and food . Is that possible that I will be obligated for such amount?

Re: child support

You've probably miscalculated the additional amount that daycare would add to your share of the basic child support obligation that you would be responsible for under the Virginia guidelines.

Per subsection F of Sec. 20-108.2 of the Code of Virginia, the amount of daycare expense is added to the basic child support obligation shared by both parents, which is then divided out in proportion to each parent's income that is usable for the purpose of determining the support obligation of each.

Bottom line: each parent shares in the expense of daycare for the child(ren)in proportion to her or his income, and only a reasonably priced one(daycare provider) which is duly licensed need be considered.
