Legal Question in Family Law in Virginia
Child Support/Custody
Child Support is handled through DCSE; Fathers (noncustodial parent) support based on overtime that is not guaranteed, income has decreased approx. $3,000 from last support hearing, mother has voluntarily quit a job of 16 years and has withdrawn child from daycare. Child will be 11 years old September 5, 2002. How does judge determine child support, will father be responsible for 100% of child support given that mother, custodial parent, voluntarily quit job? How does one get information from her employer verifying that she voluntarily quit? If mother gets job between now and the upcoming DCSE hearing and states that she will be using daycare in the future how is this determined by judge?
Also, father can not get a written assessment from child's counselor after several attempts nor was attorney able to get a response in preparation for visitation hearing. How does father go about getting such an assessment from counselor.
