Legal Question in Family Law in Virginia

i had a child with my ex (unmarried) in the state of VA. I have moved to NV with my daughter and now he is filing for joint custody/visitation. How will visitation of a 2 year old work when we are on opposite sides of the country?

Michael Hendrickson Law Office Michael E. Hendrickson

Before any custody/visitation issues can be adjudicated, this alleged father

will have to establish in court that he is in fact legally the father of this child

and therefore entitled to at least visitation rights.

And, if he filed his case in Virginia rather than Nevada after the child had been

in continuous residence in Nevada for more than six months,

the Virginia court will likely dismiss his case for lack of jurisdiction which

in that case would now lie with Nevada.
