Legal Question in Family Law in Virginia

children during divorce proceedings

a friends husband is filing for divorce. they have two children 17 and 13. she wishes to travel back to the UK next summer with the children for six weeks as they usually do each year to visit her parents. can her husband stop her from taking the children? if so, can she travel on her own or could she be cited for abandonment? how would this period overseas affect her legal rights regarding her children?

Re: children during divorce proceedings

I see no effect whatsoever.

Your friend would be free to continue taking her children on their annual trip to Europe unless there was a court order prohibiting such travel(not likely).
