when a parent dies and there is a stepparent involved and there is no will what rights does the children of the deceased have as far as being entitled to or a childs 3rd

The surviving spouse of the decedent and step-parent of decedent's surviving offspring normally is entitled to 1/3 of the estate assets after all creditor's claims and charges against the estate have been satisfied. The surviving offspring divide up the remainder.
