Can my children use the last name of their step father

I remarried in 2001. I have sole legal custody of my two children from my first marriage. My ex lives in NM where the divorce was finalized. Can my children use their step fathers last name for all purposes that are not legal. For example, they are registered at school with their legal name but the kids and teachers call them by my husbands name.

For the kinds of informal uses which

you've described, the kids can, basically, be called anything they want.
