Legal Question in Family Law in Virginia

Children's Choice

I am a 15 year old child, living with my mom in Virginia. I do not wish to visit my dad, but he is supposed to get me and my 3 younger siblings every other weekend. Am I allowed to choose not go to his house?

Re: Children's Choice

I would encourage you to go see your Dad, even if your mother does not approve, and try and improve your relationship with him. He is the only Dad you have.

Re: Children's Choice

Your mother is under a court order to provide you to your father at a certain time and place. She can be held in contempt of court if she fails to do so.

I take it you have a good reason for not seeing your father and it is not a juvenile reason (like you'd rather be at the mall). To me, this means that your father is failing you in some way. Your mother should take him back to court and ask the judge to appoint you a Guardian who would represent you and not your mother or your father. The Judge can make orders to your father (such as he go to counseling) if he wished to continue his visitation.

The correct answer is that you should WANT to be with him and if you don't - the situation needs to be fixed. You have little enough of your childhood left. Once you have a driver's license, neither parent will see you much.

Obey the order and work to have it changed.

Good luck.
