civil to criminal child support cases

my fiance is incarcerated at fauquier county jail.. for non payment of child support. there are alot of twists in this case. the judge is friends with the plaintiffs father. the judge has never tried to take his license or garnish wages. but now they are saying that if he isnt out of jail by april 13th it will get moved from civil court to criminal. can they do that .. being this is only his 1st time incarcerated and his 2nd time getting in trouble with child support. and being that hes already in jail. if they're any laws that you can direct me to find this information out i would appreciate it. thank you very much

Your fiance would now appear to be at the stage in his obviously delinquent child support case where it would be strongly advisable for him to have the services of an attorney representing him in this matter.

I suggest that either you or he contact one ASAP.
