Legal Question in Family Law in Virginia

RE: Common law marriage in Virginia?

I have been living with a woman in Virginia for over three years. Is there some sort of common law marriage provision in this state. If so, what are the provisions and how is this usually dealt with when breaking up?

A common law marriage cannot be entered into in Virginia. However, a common law marraige established elsewhere and valid where entered into will be recognized in VA. If you have any questions please call my office at 301-652-0663 or 703-598-9220.

No. Virginia will recognize a common law marriage established in another state, but there is no provision for parties living together in Virginia to be declared married.
