Legal Question in Family Law in Virginia

Concern about presiding judge

I just found out the presiding judge in the court I am to file spousal support was our sons best friend in high school and spent more time with my spouse than me at various school events. Should I ask he recuse himself or a change of venue or just hope it will not effect any results.

Re: Concern about presiding judge

Make sure that the attorney(you should have) is aware of the situation and thereby can be on the alert in the unlikely event that any unseemly manifestations of judicial bias make their appearance in your case, but the judge should initially be presumed to act judiciously and conscientiously in the matter until evidence emerges to the contrary (in my opinion).

After all, that's a key part of what being a judge is all about.
