Legal Question in Family Law in Virginia

I'm going to court for sole legal and physical custody of our 0ne year daughter. My Ex is trying to get joint physical custody. When we were together he abuse me several times. Twice in front of my older sister. He even has temper issues. i made the decision to leave him while he was on deployment. Right now we have no custody aggreement and i refuse to let him see her any more with out one. I tried numerous times letting her visit him but he made constant threats on how he wasnt going to bring her back unless we got back together. He made constant threats to my family. i have proof of him admitting to his temper and him hitting me. Is this enough to try for sole custody of our daughter?

Hard to say merely on the facts recited, but you can. of course, always

try (for sole custody), but do not expect the court to deny this

father his visitation rights with his daughter.
