Do courts split custody between different states?
I have a custody hearing in May for custody of 16mo. Mom left 06/07 child has lived with me since. Mom was ordered at temp hearing on12/07 to get job,place to stay. Mom may have just gotten a place to stay and a job this month. I meet all guidelines of ''best interest'' Now mom is saying she was abused but has no proof, I have proof she left for another man and also a past protective order against her. How likely are VA courts to split custody with the mother in Fl. Currently I have primary mom only has local visitation. She is also saying I denied visitation which is not true and has no proof. I have atty, mom may not. I have been raising my 9 yo since she was 3 and splitting sisters up would be devastating. I have been primary provider since 06/07 and mom has had very limited contact, paid no support, but because she is the mother I am worried judge would allow the child be removed from my home sent to FL. I am trying to prove her cohabitation in FL but my funds are not limitless. Many more facts in my favor but do courts weigh on these decisions heavily or simply split custody since child is not in school. I feel facts are on my side but still very scared of my daughter being moved so far away from us! Thank you!

The Virginia court hearing your custody matter will not decide your custody issue by simply finding that the best intersts of your children would likely be best served by giving one child to one parent and the other child to the other parent as there are many more factors which a court
is legally bound to consider in making such a determination.
