Legal Question in Family Law in Virginia

CPS was called against me, after an extremely big misunderstanding. The police officer on site said the case would not stand and would be thrown out, however the CPS worker is founding my case, when my child was not harmed, and never has been harmed, neglected, or mistreated. What happens if a case is falsly founded? What are the grounds for founding a case for Child Abuse if there is no proof, and all evidence shows I am a good mother? Should I get a lawyer? What happens if they can't do the 30 day inspection because no one will be home?
