Legal Question in Family Law in Virginia

Custoday Help

I need help quickly. My fieance has twin boys who will be 7 next month. And they live with their mother. And well they just finished Kindergarten and they passed by the skin of thier teeth. They had been absent 26 & 27 times and tardy 60 & 70 times for the whole school year. They are not properly taken care of when they are with their mother, they are not given baths/showers daily. She does not clean their ear or cut nails. I do that when we have them every other weekend. They do not and have not slept in beds in almost a year, one sleeps on the floor and the other sleeps on a kiddie couch because their beds are not set up. The home is not clean by a long shot. When we ask to see the home the mother will not allow us to come into the home. The last time we saw the home it was filthy. You could smell the animal urin thoughout the home. We had contacted DCS and they said that they wouldn't help. We are pressed for time as she is moving out of state with the boys in 3 months.

Re: Custoday Help

The father could file for sole custody of his sons if there's been a material change in the circumstances governing their best interests since the last custody order was entered by the court,

and he could also oppose in court the mother's proposal to remove these children from the state.
