Legal Question in Family Law in Virginia

custodial parent relocating for job

What are my rights & the requirements of me as the custodial parent in notifying children's father of relocation. I am the custodial parent and my children are 9 & 15. Due to lack of jobs in our current town, in my spouse's career field + non-compete clause in a large part of the surrounding area for him, he has found a job 3.5hrs away from my childrens' father, so we will be relocating. There is currently alternate weekend visitation and alternate holidays. We've lived in VA for 2 years w/ father in NC who pick the kids up on given visitation times (apx 40 min away). With this increased distance, what are the visitation requirements likely to be and what problems I may encounter from ex.

The best advice anyone should give you here is don't make the move until you have been fully advised by your attorney.

Who could possibly answer this question: "What are the visitation requirements likely to be and what problems I may encounter from my ex?"---

without reviewing the relevant court orders and/or decrees?

However, one thing can be said in this situation with reasonable certainty: If the non-custodial parent wishes to contest your move, he will be legally entitled to do so.
