Legal Question in Family Law in Virginia

custodial power of attorney

My son aged 15 is flying with his friend and parents to Mexico. All of us are residents of Arlington, Virginia and US citizens. The mother requests that she have power of attorney to board my son on the plane unaccompanied

in Mexico City on his return to US and in case he would need to be admitted to a hospital in Mexico. What type

of document is required and is it

legally binding in Mexico.

Re: custodial power of attorney

Your son at age 15 should be able to board the plane in Mexico merely with his U.S. passport and without any special legal papers from you to the trip chaperon purporting to authorize this action.

As for a possible admission of your son to a Mexican hospital, I also doubt that anything beyond your oral authorization over the telephone

would likely be necessary (and, probably, not even that) to effect such an admission, and that a formal POA executed in the United Sates for this purpose would not be necessary (nor possibly even recognized).
